These Terms and Conditions outline the basis on which Baytt Estate Agents provides estate agency and property marketing services to clients. By instructing Baytt Estate Agents to act on your behalf, you agree to the terms set out below.

By instructing Baytt Estate Agents to market or represent your property, you agree to these Terms and Conditions. These terms apply to all services provided by Baytt Estate Agents unless otherwise agreed in writing.

  • Buyer enquiries and negotiations
  • Sales progression and communication with solicitors
  • Property transaction support services

Where specific agreements are made between Baytt Estate Agents and the client, these will be confirmed in writing.

3. Property Valuations

Baytt Estate Agents may provide property valuations for the purpose of assisting property owners in understanding the likely market value of their property.

  • Valuations are provided based on current market conditions and comparable sales data
  • Valuations are opinions and should not be considered formal surveyor valuations
  • Property values may change depending on market conditions

Baytt Estate Agents cannot guarantee the final selling price of a property.

4. Property Marketing

Once instructed, Baytt Estate Agents will market the property using a range of marketing channels designed to maximise exposure to potential buyers.

  • Online property portals
  • The Baytt Estate Agents website
  • Professional photography and marketing materials
  • Virtual tours where applicable
  • Social media marketing campaigns

While every effort is made to ensure marketing materials are accurate, property owners remain responsible for confirming the accuracy of property descriptions and details.

5. Property Viewings

Baytt Estate Agents may arrange and conduct property viewings with prospective buyers.

  • Viewings may be conducted by Baytt Estate Agents staff or by the property owner
  • Feedback from viewings will be communicated to the client where available
  • Clients must ensure the property is safe and accessible for viewings

Baytt Estate Agents accepts no liability for loss or damage arising from viewings unless caused by negligence.

6. Offers and Negotiation

All offers received on a property will be communicated to the seller promptly in accordance with UK estate agency regulations.

  • All offers will be submitted in writing
  • The seller retains full control over whether to accept or reject any offer
  • Baytt Estate Agents will negotiate on behalf of the seller where instructed

Acceptance of an offer does not legally bind either party until formal contracts have been exchanged through solicitors.

7. Legal Process and Sales Progression

Following acceptance of an offer, Baytt Estate Agents may assist in progressing the transaction by liaising with solicitors, buyers, and other relevant parties.

This support may include:

  • Coordinating communication between solicitors
  • Monitoring transaction progress
  • Providing updates to buyers and sellers

However, Baytt Estate Agents is not responsible for delays caused by legal processes, mortgage providers, surveys, or third-party services.

8. Fees and Commission

Estate agency fees and commission will be agreed between Baytt Estate Agents and the client before marketing begins.

  • Commission is typically payable upon completion of the sale
  • Commission is calculated as a percentage of the final sale price or a fixed agreed fee
  • VAT may apply where applicable

Full details of fees will be provided in the client’s agency agreement.

9. Client Responsibilities

Clients instructing Baytt Estate Agents agree to:

  • Provide accurate information about the property
  • Disclose any material facts that may affect the sale
  • Ensure the property is legally owned or authorised for sale
  • Inform Baytt Estate Agents of any change in circumstances relating to the property

Failure to provide accurate information may lead to delays or legal issues during the transaction process.

10. Limitation of Liability

Baytt Estate Agents will provide services with reasonable care and professional standards. However, we are not liable for losses resulting from:

  • Market fluctuations affecting property values
  • Delays caused by third parties
  • Incomplete or inaccurate information provided by clients
  • Mortgage lender or solicitor delays

Nothing in these terms excludes liability where it would be unlawful to do so under UK law.

11. Data Protection and Privacy

Baytt Estate Agents processes personal data in accordance with UK data protection legislation, including the UK General Data Protection Regulation (UK GDPR).

Client data may be used for:

  • Providing estate agency services
  • Communicating with buyers, sellers, and solicitors
  • Meeting legal or regulatory requirements

Personal data will never be sold to third parties and will only be shared where necessary for the completion of property transactions.
